When it comes to the cost of a divorce, I always recommend choosing mediation over litigation. Now, in most jurisdictions in Colorado, mediation will be court ordered anyway before a court will set a trial, so you’ll have to go through it anyway, but what I like to do is come in super prepared. Now, mediation just means that the two parties, the two spouses, and their attorneys, if they have attorneys, meet with a mediator and try to reach some sort of settlement everybody can live with. A mediator cannot make decisions. A judge can, but a mediator can facilitate the decisions that you and your spouse make as you’re breaking up, and that means an agreement that will be given to the court to approve without the expense of going to court.
The second way to save money during a divorce is prior to the divorce, in the relationship after you get married, put together a postnuptial agreement. Now a postnuptial agreement is basically like a prenup, only you’re already married, but you’re going to disclose all of the assets, the debts, separate property, and what you want to keep separate. You’re basically deciding how you want things to go in the event of a divorce. This can really make things very, very easy if you have to go through the divorce process.
The third way to save money during the divorce process and, really, this is just an overarching idea for the divorce process is to not engage in drama. Drama costs money, and I’m a big fan of the no drama divorce. Now I’m not talking about if there’s actual things going on that have to be addressed immediately with court intervention like addiction, or God forbid child abuse. I’m talking about people who just can’t let go, and if you’re one of them, you need to reflect on that, and remember, drama costs money.
