Colorado Lawyer Marie Drake Says Passage of New Law a Victory for Parents

GOLDEN, Colorado – Marie Drake, Attorney and CEO of The Drake Law Firm, P.C., applauds the recent passage of Colorado’s “Affirm Parentage Adoption in Assisted Reproduction” Bill HB22-1153. The bill was signed into law by Governor Jared Polis on May 23, 2022, and was co-sponsored by Senator Jeff Bridges, Majority Leaders Dominick Moreno and Daneya Esgar, and Representative Kerry Tipper.

The bill, also known as “Marlo’s Law,” was named in honor of Marlo, the daughter of Heather Palm and her wife Majority Leader Esgar who was also co-sponsor of the bill.

Marlo’s Law updated Colorado’s outdated parentage law and went into effect on August 10, 2022. The law ensures that all parents who conceive through assisted reproductive technology (ART) are entitled to the same rights and legal protections regardless of their marital status, sexual orientation, or gender identity. It also affirms parentage by adoption for a person who did not give birth when the child’s conception resulted from ART.

Since the advent of ART, Colorado law had not been updated in a significant way, making it difficult for ART-formed families to obtain assured, nationwide legal recognition without being subjected to discrimination.
